Trump Election Interference Case in Georgia Paused Amidst Legal Dispute

As the November elections approach, the 2020 election interference case involving former President Donald Trump and several co-defendants is experiencing delays.

On Wednesday, the Georgia Court of Appeals issued an order pausing proceedings in Fulton County for certain defendants, including Trump, until the court addresses an appeal concerning the disqualification of District Attorney Fani Willis.

Initially, Trump and 18 others were charged in a 41-count indictment revealed in August. While four defendants have pleaded guilty, the rest, including Trump, assert their innocence. Trump faces 13 counts in Fulton County, including charges under Georgia’s RICO statute.

The defendants affected by this order include Trump, Michael Roman, David Shafer, Robert Cheeley, Mark Meadows, Cathleen Latham, Rudolph Giuliani, Jeffrey Clark, and Harrison Floyd.

Trump’s lead defense attorney, Steve Sadow, remarked, “The Georgia Court of Appeals has appropriately stayed all proceedings against President Trump in the trial court pending its decision on our interlocutory appeal, which contends the case should be dismissed and Fulton County DA Willis should be disqualified for her misconduct.”

The effort to remove Willis began when a defense attorney filed a motion asking Fulton County Superior Court Judge Scott McAfee to disqualify Willis and special prosecutor Nathan Wade, alleging they improperly benefited from a romantic relationship. Although Judge McAfee admonished Willis, he found insufficient evidence of financial benefit. McAfee gave Willis a choice: step aside and refer the case to the Prosecuting Attorney’s Council, or Wade could resign. Wade resigned the same day, but the effort to remove Willis continues.

Following McAfee’s decision, multiple defendants joined an appeal, and Willis has filed a cross-appeal. The Georgia Court of Appeals is expected to take several months to rule on these matters.
