The gag order against President Trump is unconstitutional.


    A three-judge panel in a federal appeals court in Washington, D.C., is considering the imposition of a gag order on former President Donald Trump in a case involving federal election interference. The panel engaged in a two-and-a-half-hour discussion after hearing arguments, during which they expressed doubt regarding the positions presented by both parties. The central question revolves around whether to restore a trial judge’s order that prohibited Trump from making provocative statements directed at prosecutors, potential witnesses, and court personnel.

    Cecil VanDevender, a representative from Special Counsel Jack Smith’s office, emphasized the essential need for a gag order. He argued that such a measure is crucial to thwart any potential intimidation or threats directed toward individuals involved in the case. The accusations against Trump involve allegations of a scheme to overturn the 2020 election.

    In contrast, Trump’s lawyer, John Sauer, advocated for the court to rescind the order.


    The court refrained from an immediate decision; however, the ramifications of Monday’s proceedings will establish clear guidelines on the permissible boundaries of expression for Donald Trump. As both a criminal defendant and the prominent contender for the 2024 Republican presidential nomination, the court’s eventual ruling will dictate the extent to which Trump can articulate his views as the trial date approaches.

    Among the judges presiding over the case are Cornelia Pillard and Patricia Millett, both appointed by former President Barack Obama. Additionally, Brad Garcia, nominated by President Biden earlier this year, has joined the bench. The diverse composition of the panel adds a layer of complexity to the legal considerations, reflecting a range of perspectives and potential implications for the final decision.

    The initial imposition of the partial gag order by U.S. District Judge Tanya Chutkan occurred on October 17. This order specifically prohibited Donald Trump from making statements that targeted Special Counsel Jack Smith, as well as his staff, witnesses, and court personnel. Subsequently, the order was temporarily suspended pending a prior appeal initiated by the former president. However, on October 29, Judge Chutkan reinstated the gag order, reinstating the restrictions on Trump’s ability to make inflammatory statements in relation to the case.

    It’s important to note that the imposed order does not outright prohibit Donald Trump from expressing general grievances about the case. Judge Tanya Chutkan clarified that the former president retains the right to assert his claims of innocence and voice his belief that the case is politically motivated. Despite the restrictions, Trump is allowed to maintain his stance of denying any wrongdoing in the case. Notably, he contends that the legal proceedings are part of a concerted effort to hinder his potential victory in the 2024 presidential election.

    Trump has not refrained from vociferously criticizing those involved in the case, with Special Counsel Jack Smith frequently being a target of his sharp disapproval. Trump often refers to Smith as “deranged” in his critiques, underscoring the contentious nature of the legal proceedings and the strained relationship between the former president and key figures in the case.
